MEMBERSHIP AGREEMENT

1. PARTIES

This Membership Agreement ("Agreement") has been executed electronically between the following parties under the terms and conditions specified below:

A. "Website"
The website with the domain name ilaysmabel.com (hereinafter referred to as "Website").

B. "Member"
The natural or legal person who approves this Agreement electronically and becomes a member of the Website.

2. SUBJECT AND SCOPE OF THE AGREEMENT

The subject of this Agreement is to determine the terms and conditions regarding the Member's use of the Website and the services provided on the Website.

3. RIGHTS AND OBLIGATIONS OF THE PARTIES

3.1. Member's Rights and Obligations

- The Member accepts, declares, and undertakes that the personal and other information provided while becoming a member of the Website is correct, and that in the event that such information is incorrect, the Website will not be liable, and that he/she will compensate any damages that may arise.
- The Member is personally responsible for all transactions carried out with his/her membership account. The Member shall not share the membership information (username, password, etc.) with third parties.
- The Member agrees and undertakes not to use the Website for unlawful purposes or in a way that infringes on the rights of third parties.

3.2. Website's Rights and Obligations

- The Website may make unilateral changes to this Agreement, provided that it is announced on the Website. The changed provisions will become effective on the date of publication.
- The Website may suspend or terminate the membership of the Member in case of non-compliance with the Agreement.

4. INTELLECTUAL PROPERTY RIGHTS

All content on the Website (designs, texts, images, logos, etc.) is protected under intellectual property rights. The Member cannot copy, distribute, or use these contents for commercial purposes without permission.

5. TERMINATION OF AGREEMENT

This Agreement shall remain in force until the Member cancels his/her membership or the Website cancels the membership.

6. FORCE MAJEURE

The Website shall not be liable in cases where obligations cannot be fulfilled due to force majeure (natural disasters, war, fire, etc.).

7. GOVERNING LAW AND JURISDICTION

This Agreement is subject to the laws of the Republic of Türkiye. In the resolution of any disputes arising from this Agreement, Istanbul Courts and Enforcement Offices are authorized.

8. ENTRY INTO FORCE

This Agreement has entered into force electronically upon the Member's approval during registration.

PERSONAL DATA PROTECTION LAW (KVKK) CLARIFICATION TEXT

Data Controller:
In accordance with the Law on the Protection of Personal Data No. 6698 (“KVKK”), your personal data is processed by Naia Tekstil / İlays Mabel as the data controller within the scope explained below.

1. PURPOSE OF PROCESSING PERSONAL DATA

Your personal data is processed in order to:
- Provide you with the best service,
- Improve our Website and services,
- Carry out marketing, advertising, and communication activities,
- Perform legal obligations arising from legislation.

Pursuant to Article 11 of the KVKK, you may apply to the data controller and make the following requests:
- To learn whether your personal data is being processed,
- To request information if your personal data has been processed,
- To learn the purpose of processing and whether it is used in accordance with its purpose,
- To know the third parties to whom it has been transferred domestically or abroad,
- To request correction if it is incomplete or incorrectly processed,
- To request the deletion or destruction of your personal data,
- To request notification of these transactions to third parties to whom your personal data has been transferred,
- To object to the occurrence of a result against you by analyzing your processed data exclusively through automated systems,
- To request compensation for damages in case you suffer damage due to unlawful processing.

Applications must be submitted to Naia Tekstil / İlays Mabel in writing or via your registered electronic mail (KEP) address, secure electronic signature, mobile signature, or by using your e-mail address previously notified to our system.
